Exide has requested TCEQ assistance for obtaining property access to complete the TCEQ conditionally approved work plan for removal and disposal of slag and battery case fragments from Stewart Creek.
The TCEQ approved the Report on Interim Actions, Slag and Battery Case Fragment Removal and Disposal, dated 10/14/2013 (large file).
On November 7, 2013 Exide submitted to the TCEQ an Interim Action Work Plan (IAWP) for Slag and Battery Case Fragment Removal and Disposal to address slag and battery chips in and around the downstream portion of Stewart Creek. On December 17th the TCEQ provided conditional approval to perform the IAWP activities. The December 5, 2013 Community Meeting @ "The Depot" (Frisco Heritage Center) has been cancelled due to dangerous weather conditions.

On November 19, 2013 the TCEQ provided conditional approval of Exide's response to TCEQ and EPA comments regarding the Affected Property Assessment Report (APAR), and Tier 2 Screening Level Ecological Risk Assessment for the Former Operating Plant, dated October 29, 2013:
Exide responded to TCEQ and EPA comments on the Affected Property Assessment Report and Tier 2 Screening Level Ecological Risk Assessment for the Former Operating Plant on October 29, 2013. A copy of the response is presented on the Former Operating Plant page and on the Documents & Data page.
Exide submitted the Former Operating Plant Affected Property Assessment Report (APAR) to the TCEQ and the EPA on July 10, 2013. A copy of the report is presented on the Former Operating Plant page and on the Documents & Data page.
Exide received comments from the TCEQ and EPA on October 8th as detailed in the following documents:
Exide is in the process of addressing these comments.
Exide expects to address agency comments, make revisions to the APAR, and prepare a revised APAR. Following this process, the revised draft of the APAR will be submitted for agency review and will be reposted here on the Exide Frisco Closure website for a 30 day public review and comment period. During the public review period, Exide plans to host a public information meeting concerning the APAR. Comments received by Exide prior to the public review and comment period will be considered by Exide, but may not receive a formal response from Exide until after the conclusion of the public review and comment period.
